Recently, the "two divisions" of 135 city-level cultural relics protection units (points) (that is, the scope of protection and the construction control zone) were officially announced. So far, the existing cultural relics protection units (points) above the municipal level in our city have two statutory "talismans". This reporter learned from the Municipal Bureau of Culture, Radio, Television and Tourism yesterday.
According to reports, the role played by these two legal "talismans" is embodied in two aspects:
Firstly, no other construction projects or blasting, drilling, excavation or other operations shall be carried out within the scope of protection of cultural relics protection units.
Such acts that require such acts due to special circumstances must ensure the safety of the cultural relics protection unit, and with the approval of the people's government that has approved and published the cultural relics protection unit, the consent of the administrative department for cultural relics of the people's government at the level above shall be obtained before approval.
Secondly, construction projects carried out within the construction control zone of cultural relics protection units shall not damage the historical features of cultural relics protection units; The engineering design plan shall be submitted to the urban and rural construction planning department for approval after obtaining the consent of the corresponding administrative department for cultural relics according to the level of the cultural relics protection unit.
According to the Law of the People's Republic of China on the Protection of Cultural Relics and other relevant laws and regulations, the scope of protection of cultural relics protection units refers to the areas where key protection is carried out for the body of the cultural relics protection unit itself and a certain range of surrounding areas. The construction control zone of a cultural relics protection unit refers to the area outside the scope of protection of the cultural relics protection unit that restricts the construction project for the purpose of protecting the safety, environment and historical appearance of the cultural relics protection unit.
The red line of the protection scope of cultural relics protection units and the red line of the construction control zone are collectively referred to as the "two lines", which are the "safety line" to protect the safety of the cultural relics themselves, and also the "lifeline" related to the survival and continuation of cultural relics
